Assisted Living Regulation in Louisiana
As of July 1, 2010, the Louisiana Department of Health and Hospitals assumed responsibility for the licensing and regulation of adult residential care (assisted living) providers.

Adult residential care providers licensed prior to July 1, 2010 continue to operate under the Adult Residential Care Facility Minimum Standards (LAC 48:I.Chapter 88) adopted in 1999 under the Department of Social Services. Click on the link below to access these rules. 

DHH is in the process of working with LALA and other stakeholders to finalize new regulations for adult residential care. We anticipate that new rules will be adopted and in effect by the end of 2011.

ARCP (Level 4) Regulations
A new licensing and regulatory model for Adult Residential Care Providers was adopted in December 2008 by the Department of Health & Hospitals (DHH) as a result of legislation filed in 2004 to launch a Medicaid-funded assisted living service. This new "medical" model of adult residential care/assisted living will allow providers to administer medications (by licensed nursing personnel only) and perform limited nursing services – tasks that are not allowed under the 1999 regulations. The regulations adopted in 2008 allow for private-pay providers to be licensed under this model, if approved through the Facility Need Review process. 

The Medicaid waiver application submitted for federal government approval is still pending, so at this time, assisted living services are provided for private-pay only.

Effective July 1, 2010, under the provisions of Act 381 (which authorized the transfer of authority for regulation of adult residential care facilities from DSS to DHH), this "medical" model of adult residential care is hereby classified as the "Level 4 Adult Residential Care Provider" module.
